هل خصومة التحكيم خصومة قضائية؟، وهل تنطبق عليها مباشرة ضمانات التقاضي الأساسية التي تنطبق على الخصومة القضائية؟، وما هي هذه الضمانات؟، وأين توجد؟، هل توجد في قوانين المرافعات الوطنية؟، وهل صحيحاً أن قانون المرافعات هو الشريعة الإجرائية الأم التي تنطبق على سائر الخصومات بما فيها خصومة التحيكم؟، وإن صادر البعض على إجابة السؤال الأخير، فأين نجد المطلوب؟، هل ثمة ضمانات تقاضي أخرى فيما يعرف بالقانون الإجرائي والذي يعتبر الفقه الحديث قانون المرافعات فرعاً منه؟، أم أن ضمانات التقاضي تتحدد على ضوء التنظيم الإجرائي لكل خصومة تحكيم، فإن كان الأمر كذلك، فمن ذا الذي يحدد هذا التنظيم، وكيف يحدده؟، وهل إجابة السؤال الأخير واحدة سواء كان التحكيم داخلياً أو دولياً؟.
ونظراً لأن الواحد من هذه الأسئلة يصلح محوراً لبحث مستقل لذلك فإن حدود البحث وحصر نطاقه يفرض علينا الإجابة عنها بالقدر الذي يخدم بحثنا هذا، ولنبدأ بالسوؤال الأخير من الذي يحدد؟، وكيف يحدد التنظيم الإجرائي لخصومة التحكيم، على أساس أنه التنظيم الذي تكمن فيه ضمانات التقاضي، ونستهله بإجابة السؤال الأول هل خصومة التحكيم خصومة قضائية؟ واستطرادا لذلك وارتباطا به نشير إلى إجابة السؤال الثالث أين توجد ضمانات التقاضي؟ وهل في قوانين المرافعات باعتبارها الشريعة الإجرائية الأم؟ أم أن ثمة قانوناً إجرائياً قد استقر فعلاً، هذا كله سيكون بمشيئة الله تعالى هو محور بحثنا.
