وحتى يمكن تقديم هذه الدراسة في منهج علمي متكامل، فقد رأينا تقسيم هذا المؤلف إلى موضوعين أساسين، نتناول في الأول الالتزام القانوني بتسبيب الأحكام وهو ما نخصص له الباب الأول من هذا المؤلف، حيث نعرض لماهية التسبيب وما لا يسبب من أعمال القضاة طبقاً لنصوص القانون وأحكام القضاء، في ختام هذا الباب نعرض لوظائف التسبيب والدور الذي يلعبه في حماية المصلحة الخاصة للخصوم، وفي الباب الثاني من هذا المؤلف نتناول دراسة شروط صحة التسبيب حيث نعرض الشروط الثلاثة لصحة التسبيب، وسوف تقترن الدراسة بعرض كامل لقضاء النقض في كل مسألة من مسائل هذا البحث، كما تتضمن إشارة إلى مستحدثات قانون المرافعات الفرنسي الجديد الذي أولى هذا الموضوع عناية فائقة بالمقارنة مع قانون المرافعات القديم.
