يضم هذا الكتاب دراسة علمية جادّة، تؤصّل للمنهج الصحيح في البحث والفتوى في الفقه الإسلاميّ، المتمثل من ناحية التنظير في علم أصول الفقه، ومن ناحية التطبيق في المذاهب الفقهية الأربعة التي استقرت مدارسَ ناضجةً للتفقه والإفتاء، وأثبتت قدرتَها ـ بمناهجها الأصيلة ـ على مواكبة المستجدّات عبر العصور.
وقد مرّ البحث الفقهي بأطوار عدة عبر تاريخه الطويل، ازداد في كل طور منها نضجاً واستقراراً، حتى أوائل القرن العشرين وظهور تيار الدعوة إلى التجديد، الذي انحرف عن ذلك المنهج الفقهي المستقرّ، ليضع معالم طريقة جديدة في التفقه والفتوى تفتقر إلى المنهجية والانضباط، وظهر أثر هذا الانحراف عن جادة المنهج الأصيل في فتاوى شاذة وآراء فطيرة تتسم بالاضطراب والتناقض.
وقد تناول المؤلف موضوع كتابه هذا في قسمين رئيسين، الأول تنظيري، والثاني تطبيقي، وتناول في القسم التطبيقي باحثين ذاعت آراؤهما الفقهية، أولهما: الشيخ سيّد سابق، في كتابه فقه السنة، وثانيهما: الدكتور يوسف القرَضاوي، في فتاواه ومؤلفاته المختلفة. وقد ركّز المؤلف في عرضه ونقده لآراء الشيخين على إرجاع تلك الآراء إلى أسبابها ودوافعها المنهجية، ليكون الهدفُ كشف الخلل في المنهج لا الوقوف عند الأحكام الجزئية. وليس هذا التناول بالنقد لمنهج البحث والفتوى متوجَّهاً إلى شخصي الشيخين الكريمين، ولا غاضّاً من مكانتهما وجهدهما، ولا سيّما الشيخ القرَضاوي، صاحب المواقف الإسلامية المشهودة. وإقرار الفضائل لا ينافيه إنكار المسائل، ومقصد الكل خدمة الشريعة السمحاء.
