يعد أصول قانون المحاكمات الجزائية سياج أمان للمجتمع والفرد المتهم في آن واحد، فهو يوصل المجتمع إلى اقتضاء حقه في عقاب من أخل بأمنه ونظامه، ويحقق في الوقت ذاته للمتهم ضمانات للدفاع عن نفسه ودرء التهمة المنسوبة إليه أو تخفيفها. وتنطلق تلك الضمانات من المبدأ الدستوري الشهير القائل: إن المتهم برئ حتى تثبت إدانته بحكم جزائي اكتسب قوة القضية المقضية. ولست أدري إن كانت تجربتي المتواضعة لعدة سنوات –هي التجربة التي اكتسبتها من خلال تدريس طلاب كلية الحقوق في جامعتي دمشق وحلب وتناولت فيه شرح هذا القانون من الناحيتين النظرية والعلمية، والاتصال المستمر باجتهادات قضائنا ومحاكمنا العليا، والاطلاع على أمهات المؤلفات الفقهية التي سبرت ذلك العلم بالشرح والتمحيص، والاشتراك في بعض المؤتمرات الدولية –لست أدري إن كان ذلك يسمح لي بالتأليف في هذا الفرع الهام من فروع القانون. وعلى كل حال، فمحاولتي هذه –وهي قد تصيب وقد تخطئ- تشكل –فيما أرجو- لبنة لمن شاء البناء عليها أو الاستفادة منها، فأكون قد قدمت للمكتبة العربية هدية تستحقها.
