تحت عنوان "البديل الفقهي بين الاصطلاح والتطبيق" يقدم الدكتور محمد الدليمي دراسة في استعمال "البديل" في الفقه الإسلامي وأصوله والبديل الفقهي كما يُعرّفه المؤلف "هو تصرف ينتقل به المكلف من الحرمة إلى الحل، أو من الحل بما لا يتلاءم مع حال المكلف إلى الحل بما يتلام مع حاله، في نفس واقعة الحكم الأصلي، دون تأقيت، أو حصر، بتغيير في بعض صفاته، أو الوسائل المؤدية إليها، دون إلغاء الأصل"، وبكلام آخر هو بحث في الأوصاف الشرعية التي تتصف بها أحفاد المكلفين، فنقول: هذا فعل واجب، أو مندوب، أو مباح، أو محرم، أو مكروه، والحكم الشرعي قد يتغير من الوجوب إلى الندب، أو الإباحية، أو الحرمة، أو الكراهة، أو بالعكس، إلا أن هذا التغيير قد يكون مؤقتاً بفترة، ومخصوصاً بأفراد دون آخرين لظروف خاصة، مثال ذلك: أكل لحم الميتة، أكل لحم الخنزير، فالخطاب قد جاء فيها بالحرمة، قال تعالى: (إنما حَرَّم عليكم الميتة والدم ولحم الخنزير..)، فجاء الخطاب بحرمة هذه الأشياء، إلا في حالة الاضطرار، فرخص أن يأخذ منها قدر حاجته، غير باغ ولا عاد.
وعلى هذا يبحث الكتاب في تطبيقات البديل الفقهي في العبادات وفي المعاملات وفي الكفارات، وفي الأحوال الشخصية بالاستناد إلى آراء أهل السّنة من الفقهاء مع عرض لآراءهم واختلافاتهم للوصول إلى ما أحلّ الله وما حرّم وهي غاية كل مسلم.
وبهذا المعنى فالدراسة هي في مضمونها عقدت من أجل البحث في مفهوم البديل الفقهي، وتأصيل الأسس الابتدائية له، والوقوف على أهمية "البديل الفقهي" في التشريع، ودوره في استيعاب الوقائع المستحدثة، وأنه تتكامل به المنهجية الشرعية التي يحفظ بها حق الله تعالى وحق عباده، ومن دون أن يدعل الله المكلف في دائرة الضيق والحرج، أي هو حكم الضرورة في معالجة الأزمات التي يمرّ بها المسلم في حياته، وخاصة في الظروف الاستثنائية.
