لاشك فى أن المشرع فى تنظيمه للقواعد الإجرائية إنما يراعى الملاءمة بين اعتبارين أساسين: الأول هو ضمان فاعلية قانون العقوبات فى حمايته للمصالح الاجتماعية المختلفة بوضعه موضع التنفيذ, وسبيله فى ذلك الإجراءات الجنائية. والثانى هو ضمان الحرية الفردية تطبيقا لمبدأ أن المتهم الأصل فيه البراءة حتى تثبت إدانته, ومن ثم فلا يجوز استيفاء حق الدولة فى العقاب إلا بناء على حكم نهائى. وقد أختلف الرأى حول تغليب اعتبار على آخر. ولعبت الفلسفات والأفكار السياسية دورا هاما فى هذا المضمار. ولعل هذا هو الذى يفسر لنا الكثير من الخلاف فى الحلول الفقهية والتشريعية للمشكلات الإجرائية المتعددة.
هذا وقد حرصنا فى عرضنا للإجراءات الجنائية فى التشريع المصرى العناية, بقدر المستطاع, بتأصيل المشكلات الإجرائية تأصيلا يعين الباحث ويستفيد منه الدارس للإجراء الجنائية, كما حاولنا عرض الفقه الإجرائى الحديث وأفكاره المستحدثة من خلال دراستنا للقواعد الإجرئية دون أن نغير كثيرا من المنهج الذى اتبعه من سبقونا وذخرت بمؤلفاتهم المكتبة القانونية, ونأمل أن نكون بذلك قد قدمنا عملا مفيدا فى مجالى البحث العلمى والتطبيقى.
