يعالج هذا الكتاب موضوعاً دقيقاً من عقود البيع الدولية، فقد تم من خلاله تسليط الضوء بالبحث والتعمق على مشكلة تتمثل في حالة التعارض بين حقوق البائع مع حقوق المشتري، ويحصل عندما يباشر البائع ويعلن إرادته في إصلاح ومعالجة ما صدر منه إخلالاً بالعقد، وذلك عن طريق إصلاح العيب الذي اعترى البضاعة، وان البائع في تصرفه هذا يستند إلى المادة 48/1 من إتفاقية فينا لعقد البيع الدولي، وفي الوقت نفسه قد يبادر المشتري عن طريق الإعلان عن إرادته ورغبته في فسخ العقد مما يتعارض كليا مع الحق الممنوح للبائع في إصلاح عيوب البضاعة، وان حق المشتري في الفسخ لم يأت من فراغ، بل يجد أساساً قانونياً وهو المادة 49/1 من إتفاقية فينا لعقد البيع الدولي. فالكتاب عالج هذه المشكلة بشأن التداخل بين هذين الحقين، وكان الأساس في معالجة حل المشكلة هو مبدأ المخالفة الجوهرية في ظل نصوص إتفاقية فينا لعقد البيع الدولي، والتي كان لها دور بارز في طرح الحل المعقول.
وقد اعتمد المؤلف في دراسة الموضوع على خطة علمية تتكوّن من الآتي:
الفصل الأول: تحديد مفهوم المخالفة الجوهرية في عقود البيع الدولية.
الفصل الثاني: حل مشكلة التداخل بين حق المشتري في فسخ عقد البيع الدولي وحق البائع في إصلاح الخلل في تنفيذ الإلتزام.
