هذا الكتاب "عقد الزواج العرفى- اركانه وشروطه و أحكامه - جمعت فيه احكام الزواج الشرعى الصحيح و الزواج غير الصحيح (الفاسد، الباطل)، وصولا الى حكم الشرع فى الظاهرة الخطيرة التى سادت شباب جامعتنا و معاهدنا العليا، بل و التى امتدت الى طلبة و طالبات مدارسنا الثانوية، التى ارتبط ذكورها باناثها بروابط جنسية تحت مسمى "الزواج العرفى" بزعم انه زواج شرعى ينقصه الافراغ فى وثيقة رسمية، وهو ارتباط يتم فى غيبة ولى الفتاة، وفى غفلة من الأهل، وتحوطه السرية، ولا يمت للزواج الشرعى بثمة صلة، ولا يعدو ان يكون زنى محرم شرعيا.. يبشر بالفقر فى الدنيا.. و العذاب الشديد فى الآخرة. وحين عقدت الندوات لناقشة هذه الظاهرة الغريبة على مجتمعنا، هالنى ما سمعت من شبابنا وما طرحوه دفاعا عن مسلكهم المشين من علل تتصل بظروف اقتصادية و اجتماعية الى سلوك هذا السبيل لاشباع شهواتهم الجنسية بعد يأس من امكانية توفير متطلبات الزواج المالية.
لقد سجلت البيانات (6) مليون حالة زواج عرفى فى مجتمعنا ونسبة باب الجامعة المتزوج منها عرفيا وصلت إلى 18% والخطورة الحقيقية تكمن فى الزواج السرى العرفى، فلا تتوافر عنه اية بيانات واقعية صادقة. ونبادر إلى القول بأن الزواج العرفة زواج صحيح شرعاً، إذا توافرت اركانه وشروط صحته و تحققت فيه مقاصد الشريعة الإسلامية التى سوف نعرض تفصيلاً فى ابواب هذا الكتاب وفصوله.. وإذا لم يتم الالتزام بها، انصرف عنها وصف الشرعية، بل وقد ينسحب عنها وصف الزواج اصلاً، فتكون زنا محرم شرعاً.
