إن من أعلى الحقوق منزلة وأكثرها أهمية، وأشدها خطرا، ذلك الحق موضوع الدراسة التي نقدم لها وهي: "الحماية المقررة لحقوق المؤلفين الادبية -دراسة مقارنة في الفقه الاسلامي والقانون"، حيث لا يخفي على أحد من الباحثين مدى اهمية هذا الحق في حياته، وذلك من منطلق ما يكابده الباحث أو المؤلف أو المبتكر عموما في اعداد بحثه وتأليفه حتى يخرج الى الناس ثمرة يانعة، وفكرة سائغة يسهل استيعابها والاستفادة منها، ان المؤلف لا يصل الا بعد مكابدة عقلية وبدنية، وصبر مرير يعيشه المؤلف مع موضوعة فكرة فكرة، ومسألة مسألة، فيقتلها بحثا ويعيش معها تحليلا ودراسة وتأصيلا، ثم يقوم بترتيبها ترتيبا مقصود يقوم على خطة منهجية تستند الى اعراف علمية، وتستهدف غاية محددة تتمثل في نتيجة يريد المؤلف ان يصل اليها ليوصلها للناس، حتى يستفيدوا منها.
لهذا كله!! كان من حق المؤلف أو المبتكر ان يحمي حقه على مؤلفه بما يستتبعه قيام هذا الحق من عائد مالي أو أدبي، وقد وجد الجانب المالي من حق المؤلف عناية أكثر من جانب الفقه، ربما كان السبب فيها تشعب العلاقات المستفيدة من الثمار المالية للمصنف والعناية الخاصة التي يستأثر بها الجانب المادي في واقع الحيا عموما، ووجدت هذه الاهمية صدى واسعا فيما كتب عن حقوق المؤلف وقد لاحظت أن الجانب الأدبي منه لم يأخذ بعد مايجب أن يكون له من اهتمام، مع ان اهميته في نظري لا تقل عن الجانب المالي أن لم تزد، وقد اردت من خلال هذا البحث أن يكون تعبيرا عن توازن النظر الى جانبي حق المؤلف أو المبتكر، بعد استشعرت نقصان اهتمام الباحثين بالجانب الادبي لحق المؤلف في الفقه عموما، وفقه الشريعة الاسلامية على وجه الخصوص، ومن ثم فان هذه الدراسة سوف تقتصر على الجانب الأدبي من حقوق المؤلفين، وما تستتبعة تلك الحقوق من حماية.
