توجد قضايا قانونية هامة، ظلت معلقة أكثر من خمسين عاماً بين الدولة والكنيسة، لم تجد لها حلاً حتى الآن، وهي قضايا أهم بكثير من قضية بناء الكنائس وترميمها، التي أوشكت الدولة على حلها عن طريق مشروع القانون الموحد لبناء دور العبادة. ومن القضايا الهامة التي لازالت دون حل حتى الآن، قضية تطبيق الشريعة الإسلامية على زواج المسيحيين في حالة الاختلاف في الملة أو الطائفة، رغم وجود حل سهل جداً لهذه القضية في قواعد تنازع القوانين المنصوص عليها في القانون المدني. ومن هذه القضايا المتعلقة أيضاً، قضية عدم اعتراف الكنيسة بالطلاق أو التطبيق الذي تصدره المحاكم، إذا لم يكن متفقاً مع ما قاله السيد المسيح في الإنجيل، عن عدم جواز الطلاق إلا لعلة الزنا. وهذه القضية يسهل حلها أيضاً على مرحلتين: الأولى هي حل القضية السابقة المتعلقة بتطبيق الشريعة الإسلامية على المسيحيين دون مبرر. أما المرحلة الثانية، فهي وضع نظام يسمح للمسيحي المطلق الذي ترفض الكنيسة عقد زواج ثان له، بأن يعقد زواجاً مدنياً، يضع شروطه وإجراءاته وزير العدل. ويظل هذا الزواج المدني الاستثنائي محكوماً في آثاره وانحلاله بأحكام الشرائع المسيحية. وهذا الزواج المدني الاستثنائي الذي اقضته الضرورة، يظل محصوراً في الحدود الضيقة التي وضع من أجلها. وهو يختلف في الدرجة والنطاق عن الزواج المدني في فرنسا والدول الأوروبية الأخرى.
ونظراً لأن هذه القضايا المعلقة سببت ضيقاً وحرجاً واحتقاناً في المجتمع، لأكثر من نصف قرن، رغم أن حلها في غاية السهولة واليسر، فقد طلب مني العديد من زملائي من أساتذة القانون في مصر، وأساتذة القانون المقارن في أوروبا، أن أعرض هذه القضية أو القضايا، عرض سهلاً واضحاً على الرأي العام، وعلى المسئولين في الدولة والكنيسة، بعد كل الوقت الذي ضاع في انعدام الحوار، وعدم الفهم، والخلط بين الأمور، وترك المشاكل دون حل. وها أنا استجيب إلى هذه الدعوة الكريمة.
