إن حق الإنسان المضطهد في اللجوء إلى مكان آمن ينعم فيه بالحرية والإستقرار من الثوابت التي أقرتها الشريعة الإسلامية وبينت أحكامها من خلال عقد الأمان المنصوص عليه في القرآن الكريم والسنّة والإجماع...
ويعامل اللاجئ سياسياً خلال مدة إقامته في دار الإسلام معاملة مواطني الدولة من حيث حقه في ممارسة شعائره الدينية، والتنقل بحرية والتعلم والعمل والإستفادة من مرافق الدولة والتخاطب بلغته الأصلية، وأما الواجبات الملقاة عليه فهي إحترام شعائر الإسلام والإلتزام بالقوانين النافذة، وعدم التظاهر بمحرمات الإسلام، وعدم تعريض أمن الدولة للخطر...
ويتبع حق اللجوء الذي يمنح للفرد، الحق في إستقدام أسرته وإدخال أمواله...
وإذا غادر اللاجئ دار الإسلام، أو مات خلال فترة اللجوء، تُحفظ حقوقه وأمواله لورثته سواء كانوا في دار الإسلام أو دار الحرب على تفصيلات ذكرها الفقهاء....
إن أنظمة الشريعة الإسلامية المتعلقة باللجوء منسجمة تماماً مع سماحة الإسلام وعدله، وسعيه لنشر السلام في أرجاء الأرض، وتحقيق الوفاق والوئام بين سكانها على إختلاف أعراقهم...
