من المقرر في مجال الاجتهاد الفقهي أن "الراي مشترك" كما قال عمر بن الخطاب ن ذلك المجتهد العظيم الذي لم يلحقه أحد بعده ، ولم يفر أحد فرية كما قال عنه رسول الله صلى الله عليه وسلم. ومن العلامات البارزة لرقي الشعوب والحضارات أن يكون الرأى فيها حيا متجددا ثريا- وهذا ما كان واقعا معيشا في العصور الذهبية للحضارة الإسلامية، ولعل من نتائجه ما نجده اليوم بين أيدينا من ثروة فقهية عظيمة. ولما كانت الأسرةة- وما بها من علاقات ، وما يشوب هذه العلاقات من شوائب- في بؤرة اهتمام الشرع والقانون، باعتبارها اللبنة الأساسية في صرح المجتمع المسلم- فقد اجريت تعديلات في بعض أحكام قوانين الأحوال الشخصية بجمهورية مصر العربية. ومما لا شك فيه أن وزاء هذه التعديلات نوعا من الاجتهاد الفقهي. وقد جاء هذا الكتاب حاملا بين دفتيه دراسة فقهية للأحكام الشرعية التى تضمنها قرار التعديل، مزودا بتأصيل هذه الاحكام من أوثق الكتب الفقهية في المذاهب المختلفة، منتهيا إلى أن بعض هذه الأحكام موافق لنصوص الشريعة محقق للمصلحة وبعضها الآخر غير ذلك، مع تقديم المبررات والاسانيد لكل، إضافة إلى العرض المين لأدلة المخالف ودراستها باستقصاء وتفصيل.
