كان لمنهج عمر بن الخطاب وتجربته التشريعية ما جعله مثالاً متفرداً حتى بين صحابة رسول الله صلى الله عليه وسلم، فعلى الرغم من الفارق الزمني بين القرن السابع الميلادي عصر عمر، وبين القرون التالية له حتى القرن العشرين، لا نجد خطة تشريعية تطاول خطة هذا الرجل من حيث تحرر الفكر من قيود التقليد الضيقة، والالتزام الحرفي بظواهر الأمور وأشكالها، ومن حيث النظرة لمصالح الناس ومقاصد التشريع وأهدافه العامة وأسسه ومقرراته.
وقد جاء هذا الكتاب ليظهر عظمة عمر بن الخطاب وعبقريته، وتناول منهج عمر في التشريع من وفاة النبي صلى الله عليه وسلم إلى وفاة عمر بن الخطاب. ومن ذلك رسالتي القضاء المشهورتين المنسوبتين له، ومنهج عمر في إثبات نصوص السنة وتدوينها وروايتها. وموقفه من المؤلفة قلوبهم، وإحياء الأرض الموات، وإقطاع الأرض، والأرض المحمية، والصوافي، وصرف خمس الغنام، وتخميس السلب، وقيمة الدية.
كما تناول الكتاب فلسفة عمر في العقوبة في الإسلام، فتناول مسائل: حد السرقة، وحد الزنا، وعقوبة شرب الخمر، وقتل الجماعة بالواحد، والعفو عن جزء من الدم، وغيرها.
كما تناول الكتاب مسائل: نكاح المتعة، والطلاق الثلاث بلفظ واحد، والتزوج من الكتابيات. وتناول أيضاً مسائل الميراث، ومتعة الحج، وجمع الناس في قيام رمضان، وإجلاء غير المسلمين من شبه الجزيرة العربية، وأمهات الأولاد. وجمع القرآن، والتاريخ الهجري، وضريبة عشور التجارة، وموقفه من النصوص الملزمة في الكتاب والسنة، وموقفه من رأي أبي بكر واجتهاده، وموقف عمر من الإجماع، والاجتهاد، والقياس، والمصلحة، والتعزيز، وسد الذرائع، والحكم بالقرينة القاطعة وحدها، وغيرها من الموضوعات التي لا غنى لمسلم عن معرفتها.
