نقرأ في هذا الكتاب (بحوث جنائية) متخصصة في الإعتداءات التي يتعرض لها الحاسب الآلي وهي محاولة لاستجلاء حقيقة كفاية أو عدم كفاية الوسائل التقنية لحماية برامج الحاسب الالي ومن ثم النصوص القانونية الواردة في قوانين غير جنائية، أي أن المؤلف سيحاول ومن خلال هذه البحوث الإجابة عن السؤال الذي قد يتبادر إلى أذهان البعض والذي مفاده: هل ثمة مبررات جدية وملحة تجعل من الحماية الجنائية لبرامج الحاسب الآلي أمراً مطلوباً؟ ولا سيما أن البرامج يمكن حمايتها بوسائل فنية أو تقنية، إلى جانب أنها يمكن حمايتها بالنصوص القانونية التي تقرها نصوص قانون حماية المؤلف؟
ولهذا الغرض تأتي مبررات ضرورة إقرار فكرة الحماية الجنائية لبرامج الحاسب الالي، وهو ما يتم بحثه في جملة هذه (البحوث الجنائية) التي كان المؤلف قد نشرها في مجلدات علمية محكمة، وقد آثر جمعها في كتاب واحد كمادة علمية ذات أهمية، تحاول - وفقاً للمؤلف - أن ترسم، وعلى حسب تواريخ نشرها التطور الفقهي والتشريعي الذي شهدته التشريعات الجنائية من الإعتداءات التي ترتبط بتقنية المعلومات أو، بالأحرى التي تنال من مكونات الحاسب الالي ذات الطبيعة غير المادية على وجه الخصوص، لذلك وقع الإختيار على أهم البحوث التي تحقق الهدف المرجو من المؤلف.
يضم الكتاب أربعة أوراق بحثية جاءت تحت العناوين الآتية:
1- البحث عن حماية جنائية للبيانات والمعلومات المخزنة في الحاسب الآلي.
2- جمعية الدخول إلى النظام الآلي لمعالجة المعطيات عن طريق الغش.
3- مدى تطبيق نصوص جرائم الإتلاف أو التخريب على الإتلاف الذي يتعرض له الحاسب الآلي.
