لقد أردنا من هذا المؤلف أن يكون سبيلاً لعرض القواعد التي يمكن أن يسير عليها التحقيق الجنائى بغض النظر عن خصوصية هذا البلد أو ذاك مع عدم النظر إلى القواعد التفصيلية التي يمكن أن يتميز بها هذا البلد او ذاك بشأن تفصيلات التحقيق الجنائي فقد استشهدنا بالأصول القانونية التي تحكم البحث والتحقيق كلما كان ذلك ممكناً.
ومع ذلك نستميح القارئ الكريم العذر إن طغت في بعض الصفحات الجوانب الفنية أو الجوانب العملية على الجوانب القانونية. وقد حاولنا انسجاماً مع ما تقدم وابتعاداً عما يمكن أن يثير اللبس أن نستخدم عبارة محقق لكل من يتولى التحقيق إن كان يمثل سلطة اتهام أو كونه أنه يقوم بالتحقيق بصفة أصلية، أي سواء كان من أعضاء النيابة العامة في ظل الأنظمة التي توكل أمر التحقيق ومباشرة الدعوى العمومية أو الجزائية لها، أم كان من يباشر التحقيق هو من أعضاء السلطة القضائية، أي قضاة تحقيق في ظل الأنظمة التي توكل التحقيق للقضاة.
وقد كان لنا أن ننهج نهجاً يبتعد قدر الإمكان من التركيز على جانب على حساب جانب أخر بل حاولنا الموازنة في جميع ما يتعرض له هذا المؤلف وقد سارت خطة البحث على النهج الآتي:
لقد ألزمتنا الدراسة العلمية للموضوع أن نقسمه إلى ثلاث أبواب نبين في الأول موضوع التحقيق الجنائي وفي الثاني أشخاص التحقيق والصفات التي ينبغي أن يكونوا عليها والملومات التي ينبغي أن تكون شخصياتهم، وفي الباب الثالث والأخير نبين الأصول والقواعد التي ينبغي اتباعها في العملية التحقيقية أو التي ينبغي أن تحكمها.
