في اليوم الثامن عشر من شهر يوليو من عام 1992 صدر برئاسة جمهورية مصر العربية القانون رقم 97 لسنة 1992 "بتعديل بعض نصوص قوانين العقوبات، والإجراءات الجنائية، وإنشاء محاكم أمن الدولة، وسرية الحسابات بالبنوك، والاسلحة والذخائر"، تنص مادته الحادية عشرة على أنه ينشر في الجريدة الرسمية ويعمل به اعتبارًا من اليوم التالي لتاريخ نشره، وقد نشر القانون في الجريدة الرسمية- العدد 29 مكررًا- في ذات يوم صدوره، وأصبح ساريًا في الزمان اعتبارًا من يوم 19 يوليو عام 1992.
وقد كان طبيعيًا بعد صدور هذا القانون أن يتناوله الفقه بالشرح والتفسير، وقد صدرت في ذلك مؤلفات بذل واضعوها جهودًا محل تقدير وثناء. وإذا كنت قد وجدت في نفسي شجاعة لا أحسد عليها دفعتني إلى مشاركة هؤلاء عبء ما تحملوا.
ولقد خصصت الجرائم الإرهابية وحدها بالدراسة؛ ولذلك جاء تقسيم هذا المؤلف على النحو الآتي: باب تمهيدي في التعريف بجرائم الإرهاب وتحديد طبيعتها ويتضمن دراسة تاريخية لتشريع هذه الجرائم والتعريف بها وتحديد عناصرها، الباب الأول في الجرائم والعقوبات وينقسم إلى فصلين. خصص أولهما لبيان هذه الجرائم وتحديد عناصر كل جريمة وعقوبتها الأصلية، وخصص الثاني لدراسة أحكام المعاقبة على هذه الجرائم، الباب الثاني في الملاحقة بالعقاب وينقسم إلى فصلين. يتناول أولهما "الملاحقة بالعقاب وبيان الاختصاص الولائي لجهات القضاء"، ويتناول الثاني الأحكام الخاصة بملاحقة جرائم الإرهاب بالعقاب.
وقد أغفلت في دراسة الأحكام المتعلقة بهذه الأحكام الحكم الخاص الذي ورد به نص المادة العاشرة من القانون رقم 97 لسنة 1992 في شأن المانع الخاص من العقاب الذي يحول دون رفع الدعوى الجنائية ببعض جرائم الإرهاب، نتيجة عدم سريان حكم هذا النص في الزمان بمضي مدة الشهر من تاريخ العمل بالقانون، وهي المدة التي حددها النص للقيام بالإجراء الذي يتحقق به مانع العقاب.
