دفعني إلى معالجة موضوع حق المجني عليه في تحريك الدعوى العمومية واختياره موضوعاً لهذه الرسالة, ما وجدته من ارتفاع نبرة الدعوة إلى الاهتمام بحقوق المجني عليه وكفالتها, وأخصها هو حقه في تحريك الدعوى العمومية, ورأيت أن توصيات المؤتمرات الدولية كثيراً ما تساير الاتجاه الغالب في التشريعات, وهو ما قد يؤدي في ظل الاتجاه الفكري الحديث الذي يهتم بكفالة حقوق المجني عليه إلى خفوت صوت لا يساير اتجاهاً قد غلب على التشريعات وإنما يقوم على فكر تحليلي نقدي حر قد يواكب رأياً غلب وقد يقف منه موقف المعارض, وقد يقترح جديداً يمزج بين أكثر من اتجاه. فرأيت أن أبسط في هذه المسألة رأياً أعتقد أن البحث العلمي المجرد قد صاغه, غير ملتزم سلفاً برأي أو مذهب أنتصر له.
ولعله قد شجعني على طرق هذا الموضوع ما رأيته مثاراً من مسائل نتيجة اتخاذ الدعوى المدنية وسيلة لتحريك الدعوى العمومية من المجني عليه في ظل نظام الاتهام العام.
فقدرت أن تكون هذه الرسالة محاولة لتأصيل موضوع تحريك الدعوى العمومية من المجني عليه, فكان لزاماً على أن أتتبع هذا الحق خلال المراحل التاريخية الأولى للتشريع, متلمساً هذا الحق في التشريعات القديمة والوسيطة, لأنتقل بعد ذلك إلى بحثه في النظامين الإجرائيين اللذين ينتظمان التشريعات الحديثة والمعاصرة.
