حاولت هذه الدراسة في معالجة قضايا العذر الطارئ، وأثره في عقود المعاوضات المالية في الفقه الإسلامي، فحددت في فصلها التمهيدي مفهوم العقد، وتقسيماته المختلفة، ومفهوم المعاوضة، وأنواعها، وأهمية الأخذ بمبدأ العذر الطارئ في عقود المعاوضات المالية.
أما في فصلها الأول؛ أخذت الدراسة منحى التأصيل الفقهي من حيث بيان مفهوم العذر الطارئ، وصلته بمبدأ الضرورة، والتعسف، والجوائح، وبيان أنواعه، ومجال تطبيقه في العقد، والأساس الذي ينهض بمشروعيته، ومؤيدات ذلك، وشروطه، وضوابطه ومعاييره.
أما في فصلها الثاني؛ فعالجت تطبيقات مبدأ العذر الطارئ (عقد الإجارة، والمزارعة، والمساقاة، والمقاولة، والتوريد)، وبينت مدى سريان أحكامه عليها، والأثر الذي يترتب على ذلك.
أما الفصل الثالث؛ فورد فيه بيان حقيقة الظروف الطارئة في القانون الوضعي، وصلته بالقوة القاهرة، وبيان مجال تطبيقها، وشروطها، والآثار المترتبة على إعتبارها، وأوجه الإتفاق والإختلاف بينها وبين مبدأ العذر الطارئ في الفقه الإسلامي، ومدى صلاحية مبدأ العذر الطارئ أساساً لنظرية الظروف الطارئة في الفقه الإسلامي.
أما الخاتمة؛ فتضمنت أهم نتائج البحث.
