تطورت التشريعات الجنائية في هذا العصر تطوراً ملحوظاً، وتعرضت لكثير من التعديلات والتغييرات حتى تكون مواكبة لتطور الحياة وما يستجد فيها من مشكلات عملية تقتضي مواكبتها هذه التعديلات أو التغييرات، وكان من بين تلك التشريعات الجنائية التي تعرضت للتعديل والتطور تشريعات التشرد والاشتباه، وكذلك عقوبة الوضع تحت مراقبة الشرطة.
ولما كانت هذه القوانين والعقوبات تفتقر إلى مرجع يجمع شتات أحكامها، التي كثيراً ما تعدلت حتى اختلط أمرها على بعض الباحثين ورجال القانون بشأنها، وقد أردت بهذاالجهد المتواضع جمع أحكامها طبقاً لآخر تعديلاتها وما صدر بشأنها من تشريعات متتالية، ومبادئ قانونية قررتها محكمتنا العليا، وقيودها وأوصافها القانونية، وتعليمات النيابات العامة الخاصة بها، حتى يسهل على الباحث الإلمام بها دون استغراق لجهده ووقته، وقسمت هذه المؤلف إلى بابين على النحو التالي:
الباب الأول: جريمة التشرد، الباب الثاني: جريمة التسول.
