لقد أدركت أثناء إعدادي لمجموعتين سابقتين، إحداها تناولت قضايا "شريك، شراكة، شركة" والأخرى تضمنت قضايا "العلاقات التجارية والأسماء التجارية"، أهمية موضوع الإجارة. واللافت للنظر أن عدد القضايا المعروضة أو المفصولة كثير جداً، وتشكل على سبيل المثال، لا الحصر، مجموعة ضخمة تزيد بكثير عن القضايا التي أعددتها في المجموعتين المشار إليهما أعلاه.
وإذا تمعنا في شرائح المجتمع وطبقاته، بصورة عامة، فإن غالبية أفراده مؤجرون ومستأجرون، بالنظر لتشابك العلاقة بين المؤجر والمستأجر، وتضارب المصالح، أحياناً، فإن خلافاً يمكن أن يقع بينهما، وعندئذٍ لا مناص من الاحتكام إلى القضاء، صمام الأمان، الذي ينزع فتيل الخلاف، ويقضي بينهما بالعدل.
وحري بالإشارة أ، أحكام المحاكم، في المملكة الأردنية الهاشمية، ليست ملزمة من الناحية النظرية، إلا في القضية الصادر بشأنها الحكم المناسب. بعبارة أخرى أن الحكم الصادر لا يلزم المحاكم الأخرى، في القضايا المنظورة أمامها، ولو تماثلت ظروف القضايا فيما بينها، إذ نجد العديد من اجتهادات المحاكم المخالفة، أحياناً لبعضها البعض.
وغني عن البيان أن ما أقره القضاء، يعد مصدراً من مصادر القانون الذي نص عليها في القانون، ولكنه يظل مصدراً استرشادياً، ومع ذلك فلاجتهادات المحاكم، من الناحية العملية، احترام كبير يفوق بنظري، الترتيب المنصوص عليه في القانون.
ونظراً لأهمية الاجتهادات القضائية بعامة، وموضوع الإجارة بخاصة، قمت بإعداد المجموعة الثالثة من سلسلة مجموعة المبادئ القانونية المنشورة في مجلة نقابة المحامين" وعنونتها بـ "مجموعة المبادئ القانونية، قضايا المالكين والمستأجرين، إيجار وبيع الأموال غير المنقولة في الأجانب، استئجار العقارات لمصالح الحكومة، تنظيم عقود الإيجار... وعلى غرار المجموعتين السابقتين، وضعت في خاتمة الكتاب للتسهيل على القارئ، الذي يبحث عن القرار المناسب، كما أضفت إلى ذلك كله، مجموعة القوانين المرتبطة بموضوع الإجارة من أجل مزيد من التيسير على المعنى بذلك.
