إن الانتخاب يعد اللبنة الأساسية في البناء الديمقراطي ويعد الانتخاب أيضًا المؤشر الرئيسي لشرعية السلطة في الدولة الحديثة، ولأجل هذا اعتبر الإخلال بقواعده إخلالًا بأحد أهم أسس الدولة ومساسًا بتطلعات الشعب وخياراته الاستراتيجية؛ وقد نظم المشرع الجزائري جزاءات الإخلال بالقواعد والقوانين الانتخابية ضمن قانون الانتخاب، وأيضًا ضمن قانون العقوبات، وتعدد هذه الجرائم مرهون بتعدد المراحل التي تمر بها العملية الانتخابية؛ هذا إن لم نقل في جانب هام جدًا أن النص القانوني قد يكون هو الجرم في حد ذاته.
وتهدف هذه الدراسة إلى إجلاء الرؤى بشأن قانون الانتخابات، وأهم ما جاء به في مجال الجرائم الانتخابية، وأيضًا أبرز ما أوضحه قانون العقوبات في هذا الصدد إلى أن نبين أن انتهاك قانون الانتخابات يعني عدم شرعية النظام الذي كرس هذا الجرم إن كانت له يد فيه...
أما عن المنهج المتبع فقد تم الاعتماد في هذه الدراسة على المنهج التحليلي للعديد من النصوص والوقائع القانونية؛ كل هذا لاستقراء المعنى الحقيقي للجرائم الانتخابية وسبل مجابهتها على الصعيدين الوطني والدولي. تتمحور الإشكالية حول ماهية الجريمة الانتخابية والأبعاد والجهود الوطنية والدولية للحد منها؟ وذلك من خلال خطة بحث تتكون من فصلين هما: (الفصل الأول: الجرائم الانتخابية من المنظور الوطني، الفصل الثاني: المسئولية الجزائية عن الجرائم الانتخابية ودور القاضي).
