إن اختيار موضوع ميراث البنت في الشريعة الإسلامية والقانون لم يكن محض صدفة ودون سابق تفكير أو إطلاع إنما حملته على ذلك أمور كثيرة منها: الأحاديث النبوية الشريفة التي حدثت على تعلم هذا النوع من العلوم وبيّنت منزلته وفضله، فقد روي عن عبد الله بن مسعود رضي الله عنه قوله صلى الله عليه وسلم: ((تعلموا القرآن وعلموه الناس، وتعلموا الفرائض وعلموها الناس، فإني امرؤ مقبوض، وإن العلم سيقبض حتى يختلف الإثنان في الفريضة فلا يجدان من يفصل بينهما)).
والرد على الشبهات التي أثارها أعداء دين الله تعالى حول ميراث المرأة، وإدعائهم أن الإسلام قد هضمها حقها حين فرض لها نصف ما فرض للذكر، ما تتعرض له معظم النساء وخصوصاً في القرى والأرياف من هضم لحقوقهن في الميراث وإيثار الذكور على الإناث متذرعين بأعذار وحجج واهية قائمة على التمييز والظلم ومخالفة ما قدره الله عزّ وجلّ من حقوق في هذا المضمار ومن أهم هذه الحجج أن توريث الإناث من الأموال المنقولة أو غير المنقولة كالأراضي والأطيان يؤدي إلى تشتيت ملك العائلة، على إعتبار أنهنّ سيتزوجنّ وبالتالي سيشارك الأزواج والأولاد في ذلك الميراث.
