Book Description
يهدف قانون لجان فض المنازعات إلى تحقيق عداله ناجزه، بضمان وصول الحقوق إلى أصحابها دون التجاء أي القضاء. ومن ناحية ثانية، يهدف إلى تحقيق مصلحة أطراف المنازعات بالتوفيق بينهم، بما يمكن كل طرف من الحصول على كل أو بعض مايدعيه، دون أن يلجأ إلى القضاء ويتكبد في سبيل ذلك المصاريف والوقت.
ولا ينال نظام التوفيق في بعض المنازعات من حق التقاضي لأنه كما قضت المحكمة الدستورية العليا في قضائها الصادر في 6 يونيو سنة 1998 في القضية رقم 145 لسنة 19 قضائية دستورية لا يمثل نشاط لجان التوفيق مساساً بحق التقاضي في محتواه أو مقاصده لأن الالتجاء إلى التوفيق قد يغني عن الخصومه القضائية وإن كان لا يحول دونها، ذلك لأن اختصاص لجان التوفيق لا يمس حق الخصوم في الالتجاء إلى قاضيهم الطبيعي لأن اختصاص تلك اللجان لا يتضمن تعديلاً لاختصاص جهات القضاء ولا ينحيها عن مباشرة وظائفها.
وقد اشتمل القسم الأول من الكتاب على شرح وتعليق على كل مادة من مواد القانون مع تبعتها بأحكام المحكمة الدستورية العليا وبأحكام محكمة النقض وأحكام المحكمة الإدارية العليا. والقسم الثاني يشمل على نصوص القانون والمذكرة الإيضاحية وكذلك القرارات التي اصدرها وزير العدل تنفيذاً لهذا القانون.
