إنَّ هذا الكتاب سيتمحور حول فقه الإستضعاف بناء على السيرة النبوية في العهد المكي، لذلك فإنَّ هذا الموضوع له جانبان يكمّل أحدهما الآخر، أولهما: فقه الإستضعاف أي فهم وإدراك آيات الله تعالى وسنته في الكون والحياة والمجتمع، إذ المراد فقه حقائق حالة الإستضعاف وأسرارها وظروفها.
وهذا يتطلب فقه أنواع أخرى من الفقه حسب التسميات الحديثة كفقه الواقع الذي يتناول فهم الواقع سواء كان واقع قوة أو ضعف، كما أنّ له إرتباطاً بفقه المآلات والموازنات، إذ أن حالة الإستضعاف الإستثنائية تتطلب النظر إلى مآلات الأفعال، والموازنة بين المصالح والمفاسد بضوابط شرعية من أهلها.
كما أنَّ له إرتباطاً بفقه الضرورة، إذ يعتري المستضعفين ضرورة ملجئة قد تدفعهم إلى عمل غير جائز أصلاً، ناهيك عن أنّ له إرتباطاً بفقه الأقليات الذي يتناول أحكام الأقليات المسلمة التي تعيش في ظل دولة غير إسلامية.
فهذه الأنواع من الفقه تتكامل مع فقه الإستضعاف، ولكنّ البحث مختص بفقه واقع المسلمين حال الإستضعاف، وليس حال القوة، مع ضرورة وضع ضوابط الموازنة بين المصالح والمفاسد وضوابط الضرورة، وثانيهما: هو العهد المكي الذي تميز بالإستضعاف، لذا فإننا لن نتناول العهد المدني الذي تميز بالتمكين والقوة بإقامة دولة الحق، ولعل إحدى الإشكاليات المعاصرة في الخلط بين الحالتين، والواقعين، والفقهين.
إنسجاماً مع طبيعة الموضوع وأهدافه، فإني بإذن الله تعالى سأتجاوز منهج السرد التاريخي للعهد المكي الذي ركزت عليه كثير من الدّراسات السابقة، لأنّ الغرض ليس بنسخ لكتاب جديد في السيرة النبوية على طريقة السّرد التاريخي للوقائع والأحداث، بل سأعمل من خلال هذا البحث على إستنباط الأحكام الفقهية من خلال أحداث العهد المكي مع تجاوز التسلسل التاريخي للأحداث دون الإنسلاخ من واقع الأحداث وظروفها.
