في هذا الكتاب تتناول الأستاذة نادية بنزهرة قضية أساسية وحديثة ، تتمثل في تعبير القواعد القانونية لمدونة الصحافة والنشر بالمغرب من خلال مبادىء ومتطلبات الأمن القانوني . وعليه ، تتساءل المؤلفة عن مدى تكريس المشرع لمبادىء ومتطلبات الأمن القانوني على مستوى مدونة الصحافة والنشر بالمغرب .
وللإجابة على هذا السؤال وغيره من أسئلة تناولت المؤلفة الموضوع ( الأمن القانوني ) على المستوى الحقوقي والإداري والإقتصادي والإجتماعي ، كما عملت على دراسة مبدأ الأمن القانوني على مستوى القانون والقضاء الدوليين والتطبيق الوطني لذلك ، كما تمت دراسة الأمن القانوني على مستوى القواعد الموضوعية والإجرائية لمدونة الصحافة والنشر وذلك على مستويين : الأول ، الأمن القانوني على مستوى النظام التجريبي والعقابي ؛ والأمن القانوني على مستوى القواعد الإجرائية في تحريك المتابعة وتبعات الدعوى وحق الرد والتصحيح .
تطرح المؤلفة موضوع حرية الصحافة باعتبارها حرية شرعية لا يمكن تجريمها ، ولتقوم الصحافة بدورها لا بد من قانون يوازن بين الحرية والمسؤولية على مستوى نصوصه ، وبمعنى آخر أن تتوفر فيه متطلبات الأمن القانوني ، حيث أنه بالقدر الذي تتوفر فيه هذه المتطلبات تترجم وتقاس رغبة القانون والمشرع والدولة في تكريس اختيار الديمقراطية وضمان حرية الرأي والتعبير .
