Book Description
يلعب العقد الإدارى دوراً هاماص فى تسيير النشاط الإدارى, حيث يمكن الإدارة من إنشاء واستغلال وصيانة المرافق العامة, حتى تستطيع أن تؤدى خدماتها للمنتفعين بها, بصورة منتظمة ودائمة تحقيقاً للمصلحة العامة.
ونظراً لقيام ذلك العقد على فمرة تغليب الصالح على الصالح الفردى, فى حالة التعارض بينهما, فإن الإدارة تتمتع وهى بصدد إبرامه تنفيذه بسلطات واسعة يختل معها مبدأ الحفاظ على التوازن بين مصلحة طرفى العقد المعمول بها فى مجال العقود المدنية.
فبوسع الإدارة بمقتضى ما منحت من سلطات استثنائية مستمدة من كونها سلطة عامة, أن تعدل فى شروط العقد بعد إبرامه, و أن تشرف على المتعاقد معها وتوجهه أثناء تنفيذه, ولها فى هذا الأطار أن توقع عليه جزءات- و بإرادتها المنفردة- تصل إلى حد فسخ التعاقد, بل إن للإدارة الحق فى إلغاء التعاقد دون أن ينسب للمتعاقد معها خطأ, إذا لم يكن متوافقاً مع المصلحة العامة, أو لزوال المصلحة التى استوجبت إبرامه.
وأمام اتساع نطاق سلطات الإدارة فى مواجهة المتعاقد معها, و لأنه لا يجوز التضحية بالمصلحة الفردية فى سبيل تحقيق المصلحة العامة كلية, لما فى ذلك من إضرار بالمصلحة العامة ذاتها بشكل غير مباشر, فإن للمتعاقد مع الإدارة حقاً فى اقتضاء تعويض إذا ما أصابه ضرر من جراء استعمال الإدارة المتعاقدة غير المشروع لسلطاتها ويخضع تقجير مدى مشروعية هذا الاستعمال وتحديد التعويض المناسب عن الضرر الذى أوجد لرقابة اللقضاء الكامل.
ونظراً لما تمتع به العقود الإدارية من اهمية ونظام قانونى خاص, فقد رأينا إلقاء الضوء عليها من خلال دراسة تنصب على اسسها العامة- لتكون إسهاماً متواضعاً- مع ما كتبه أساتذتنا فى هذا الشأن.
ولقد آثرنا التركيز على الجوانب العملية فى تلك العقود لما للجانب التطبيقى لها من أهمية.
داعين الله جلت مشيئته أن ينفع بهذا العمل كل المشتغلين والمهتمين بالعقود الإدارية.
