برقم 328 تاريخ 7آب 2001 صدر قانون أصول المحاكمات الجزائية الجديد ثم عدّل بالقانون 359 تاريخ 16/8/2001، وللمرة الأولى يقوم أحد المؤلفين بالتعرض لمسألة قاضي التحقيق بكتاب مستقل ومقارن، وإن كانت المرة الأولى -حسب علمي- التي يقدم فيها المؤلف كتاباً قانونياً، فإنها مرة موفقة وباكورة عطاء متقدمة.
عرض الكاتب لمسألة قاضي التحقيق مقسماً بحثه إلى قسمين، بحث في القسم الأول الناحية النظرية للقواعد التي تحكم عمل قاضي التحقيق في لبنان بدءاً من المادة 51 إلى المادة 127 من قانون أصول المحاكمات الجزائية الجديد متبعاً أسلوب المقارنة الجيد بين نصوص القانون الجديد ونصوص القانون القديم، كما كان ينتهز الفرصة -كلما سنحت- بإجراء المقارنة بين النصوص اللبنانية من جهة والنصوص العربية خاصة المصرية والنصوص الأجنبية خاصة الفرنسية من جهة ثانية، فجاءت مقارنته دقيقة وأغنت الكتاب بالكثير من المعلومات.
وبحث في القسم الثاني من الكتاب في الوجه التطبيقي للقواعد القانونية التي تنظم عمل قاضي التحقيق، مميزاً بين الأمور التي اعتبرها إيجابيات في النصوص الجديدة وهي لصالح قاضي التحقيق، وبين الأمور التي اعتبرها سلبية وهي لغير صالح قاضي التحقيق، معتمداً على أحدث القرارات الصادرة عن دوائر التحقيق والهيئات الاتهامية ومحكمة التمييز الجزائية في لبنان.
من الملفت في الكتاب أن شخصية الكاتب تجلت في العديد من المواضع والمواقف، فإذا هو محلل قانوني دقيق من الطراز الأول، طارحاً رأيه متقناً حيثياته بثقة كبيرة، تشد القارئ إلى أسطر الكتاب بهدوء تجعله دائم التيقظ والانتباه.
وهو في مواضع أخرى، كاتب غير موافق للواقع الممارس، فاستعمل عبارات فيها نوع من الخروج عن المعتاد في الكتابة القانونية، فجاء ناقداً لاذعاً، مظهراً شخصيته بتجل واضح.
ويعتبر هذا الكتاب من المراجع القانونية المهمة في مجال قانون أصول المحاكمات الجزائية.
