القتل يراد به اطلاقاً ازهاق روح انسان بفعل انسان آخر، ولكن هذا التعريف يشمل صوراً متعددة من القتل فقد يكون الفعل مقترناً بنية القتل وعندئذ يسمى قتلاً عمداً، وقد يكون ناشئاً عن اهمال وعدم احتراز فيسمى قتلاً خطأ.
وقد يقترن القتل العمد بظروف تجعله أشد خطراً من القتل العادى فيعاقب بعقوبة أشد، وهذه الظروف ترجع إما إلي قصد القاتل وتصميمه وإما إلي الوسائل التي استخدامها وإما إلي الغرض الذي رمى إليه وإما إلي صفة المجنى عليه.
وقد يقترن القتل العمد بظروف استفزازية يتعرض لها الجانى حين يفاجأ بزوجته وهى تزنى فيعاقب بعقوبة أخف، بل قد يكون الجاني في حالة دفاع شرعي عن المال أو النفس حينما يرتكب جريمة القتل فيتوافر بذلك في حقه سبباً من أسباب الاباحة ويعفي من العقوبة.
وسنخصص هذا الكتاب لجريمة القتل العمد وما يرتبط بها باعتبارها من أهم الجرائم وأشدها خطراً على المجتمع وسيكون البحث فيها علي النحو التالي: الفصل الأول أركان جريمة القتل العمد، الفصل الثاني الظروف المشددة، الفصل الثالث الظروف المخففة، الفصل الرابع الاشتراك، الفصل الخامس اخفاء جثة القتيل، الفصل السادس الشروع في القتل، الفصل السابع الدفاع الشرعي.
وقد ذيل كل فصل من هذه الفصول بالتطبيقات القضائية الصادرة من محكمة النقض، عسى أن أكون بذلك قد ساهمت بجزء يسير في توضيح هذه الجريمة- فقهاً وقضاء- لرجال القانون والدارسين له والمشتغلين به.
