تبينت من دراستى لقانون الإجراءات الجنائية أن حجية الحكم الجنائي أمام القضاء المدني من أهم الموضوعات التي تستحق البحث والدراسة، إذ أن هذه الحجية تلعب دوراً في الدعوى المدنية، فلا يملك القاضي المدني أن يقضي بعكس ما قضى به الحكم الجنائي، وقد ضاعف اهتمامى بهذا الموضوع ما شاهدته واشاهده كل يوم في المحاكم علس إختلاف أنواعها ودرجاتها من الدفع والتمسك بحجية الحكم الجنائي.
وقد حرصت علي إبراز الأصول العامة التي تحكم هذا الموضوع، كما أنني في الوقت ذاته عنيت عناية تامة ببيان التطبيقات العملية لهذه الاصول العامة، وذلك لإيمانى بأن الرسالة ليست مجرد رياضة ذهنية أو نظرية مدرسية فحسب، وإنما تبدو أهمية الرسالة بقدر الفائدة العملية التي تعود من ورائها، هذا فضلاً عن أن موضوع حجية الحكم الجنائي أمام القضاء المدنى هو من الموضوعات العملية التي ينحصر مجالها في التطبيق و العمل، ولا يقف بحثها عند حد الفقه دون القضاء.
وقد انتهجت في دراستى أسلوباً منطقياً علمياً، فمهدت لدراسة هذا الموضوع بباب تمهيدى في سيادة الدعوى الجنائية علي الدعوى المدنية، ثم قسمت الموضوع إلي ثلاثة اقسام، فجعلت القسم الاول في حجية الجنائى علي المدني بوجه عام، والقسم الثانى في شروط حجية الحكم الجنائى أمام القضاء المدني، والقسم الثالث في نطاق حجية الحكم الجنائي أمام القضاء المدني.
