يتعلق حق الاسترداد بالممتلكات التي يتم انتزاعها من الأقاليم المحتلة مما يثير مسئولية دولة الاحتلال عن ذلك، فكان لزامًا علينا قبل أن نستعرض الهيكل العام لنظرية حق الاسترداد في القانون الدولي أن نعالج بصفة عامة سلطات دولة الاحتلال في الأقاليم المحتلة مع التعرض بصفة خاصة للقواعد المنظمة للتدخل في الملكية في قانون الحرب، وكذلك لأسس المسئولية الدولية بصفة عامة، ولمسئولية دولة الاحتلال بصفة خاصة عما ترتكبه هيئاتها أو أفراد قواتها من مخالفات للقواعد المتعلقة بحماية الملكية في الأقاليم المحتلة، مع الإشارة في مواضع متعددة لموقف الفقه الإسلامي من المسألة المعروضة، وعلى ذلك تنقسم دراستنا لهذا الموضوع إلى ثلاثة أبواب كما يلي: الباب الأول ونخصصه لدراسة سلطات دولة الاحتلال والحماية الدولية للممتلكات في قانون الحرب والشريعة الإسلامية، والباب الثاني ندرس فيه قواعد المسئولية الدولية ونشأة حق الاسترداد، والباب الثالث ندرس فيه نظرية حق الاسترداد في القانون الدولي وتطبيقاتها مع معالجة العلاقة بين العرب وإسرائيل في ضوء قواعد الاسترداد وتطورها.
