Book Description
رُوي عن الإمام أبي حنيفة (699-767م) أنه قال: "آخذ بكتاب الله، فإن لم أجد فسُنّة رسول الله صلى الله عليه وسلم، فإن لم أجد في كتاب الله ولا سُنَّة رسول الله صلى الله عليه وسلم أخذت بقول الصحابة. آخذ بقول من شئت منهم وأدع قول من شئت منهم، ولا أخرج عن قولهم إلى قول غيرهم، فإذا انتهى الأمر إلى ابراهيم والشعبي وإبن سيرين والحسن وسعيد بن المسيب - وعدَّد رجالاً - فقوم اجتهدوا، فأجتهد كما اجتهدوا".
وعلى هذه القاعدة، يتأسس كتاب الأستاذ أحمد خير الدين في (المسائل الفقهية في مذهب الإمام أبي حنيفة) ، قدم له بمقدمة يقول فيها: " ... فهذه خلاصةٌ من أبواب فقه المعاملات في مذهب الإمام الأعظم أبي حنيفة النُعمان، متَّعه الله بفردوس الجنان، وأمدَّنا الله بروح منه حتى ألهمنا إلى تحريرها على هذا المنوال، بعدما عُني بتصحيحها وسهر على تهذيبها وتنقيحها أستاذنا الماجد، رافع راية التحقيق باليمين، سيدي عثمان بن الخوجة ...".
وعليه، يتضمن هذا الكتاب (فقه المعاملات) عند الإمام أبي حنيفة في مسائل النكاح والطلاق والإيمان واللقيط واللقطة والمفقود، وأحكام الشركة والوقف والبيوع والكفالة والحوالة والشهادات والوكالة والدعوى والإقرار والصلح والمضاربة والوديعة والهبة والإجارة والشفعة والقسمة والمساقاة والذبائح ... وغيرها، وقد ضمّنها المصنف شرحاً للفظ كل مسألة مصطلحاً ومعنى وشرعاً ثم بيان أوجه التحريم أو الإحلال مع الأمثلة والشهادات.
