يتركز موضوع هذه الدراسة على تناول الجوانب القانونية الخاصة بالدفع باتفاق التحكيم أمام القضاء العادي في الدولة، من ناحية مفهوم هذا الدفع وطبيعته القانونية وشروط وضوابط التمسك به، هذا بالإضافة إلى إجراءات المحكمة بخصوص نظر هذا الدفع وطبيعة الحكم الصادر بخصوصه والجوانب القانونية المتعلقة بالطعن في هذا الحكم وما يترتب على كل ذلك من آثار قانونية.
وعليه فإن دراستنا لهذا الموضوع ستبدأ بتناول الجوانب القانونية المتعلقة بالدفوع المدنية والأحكام العامة المترتبة عليها والموقف في التشريع والفقه والقضاء من ذلك، ثم سنعمد إلى تناول اتفاق التحكيم نفسه وذلك بالوقوف بشكل موجز على أهم ما يتضمنه نظام التحكيم ككل ومن ثم سنتناول أهم الجوانب القانونية.
بعد ذلك سنحاول تناول الجانب العملي في الدفع باتفاق التحكيم، وعليه سنقسم هذه الدراسة إلى فصلين رئيسين يسبقهما فصل تمهيدي، مع خاتمة تتضمن النتائج والتوصيات، وذلك على النحو التالي.. الفصل التمهيدي: ماهية الدفوع ونظامها القانوني، الفصل الأول: الأحكام العامة لاتفاق التحكيم ومفهوم وطبيعة الدفع به، الفصل الثاني: التمسك بالدفع باتفاق التحكيم وآثاره القانونية، الخاتمة: النتائج والتوصيات.
