يسلّط هذا الكتاب الضوء على فلسفة النظام القانوني الذي يحكم مساءلة العاملين في السلطة القضائية من القضاة والمدعين العامين، وكيفية قيام المسؤولية القانونية للفئة المذكورة، وإجراءات المساءلة وأصولها والآثار المترتبة عليها ضمن منهج تحليلي ومقارن، كما يبحث النظام الإنضباطي للقضاة والمدعين العامين مما يفصح عن الإشارة - في الوقت ذاته - إلى الركائز الأساسية التي يجب مراعاتها في مساءلتهم بما تحفظ ماء وجه القضاء ويصون استقلاله وهو أمر - كان ولما يزل - محل تطوير كبير في التشريع العراقي والمقارن، فينطلق هذا الكتاب من مُسلمة مفادها: بأنه على الرغم من استقلال السلطة القضائية برجالاتها من قضاة ومدعين عامين، إلا أنها ليست بمنجى من المساءلة والحساب عندما يشط العاملين فيها عن جادة الصواب وهم بصدد ممارستهم لعملهم القضائي، وبالمثل أيضاً يبحث في فلسفة مساءلة القضاة والمدعون العامون عما يقترفونه من أفعال تمثل إخلالاً بالمهام والواجبات المنوطة بهم وهيبة السلطة القضائية واستقلاليتها وما يجب أن تتمتع به من موضوعية ونزاهة وحيادية في منح الحقوق والفصل في المنازعات، ضمن إجراءات وأصول معينة تبتغي الوصول إلى الحقيقة وصون هيبة القضاء واستقلاليته وتشذيبه من كل ما يمكن أن يعكر صفوه، ويقدح في أعلويته وبحسبانه صرحاً للحقوق والحريات ومناراً يضيء مسالك السائلين.
