قد تقع جرائم الإرهاب الدولي على مستوى الدول وهي بذلك تختلف عن جرائم الإرهاب الفردي، في كون مرتكب الفعل الإرهابي هو حكومة الدولة ويطلق على هذا النوع من الإرهاب إرهاب الدولة.
والواقع أن معظم الدراسات التي تناولت موضوع الإرهاب قد حاولت عدم الخوض في موضوع إرهاب الدولة نظراً لأنه موضوع شائك بكل المقاييس، بيد أنه يجب ألا نغفل حقيقة أساسية وهي أنه من الصعب أن نتفهم ونستوعب حقيقة الإرهاب الذي يمارسه الأفراد والمنظمات الإرهابية دون الوضع فى الاعتبار أن ذلك قد يكون نتيجة حتمية لاستخدام القوة والعنف من جانب الدولة.
وتعد جرائم الإرهاب الدولي والتي تمثل جرائم إرهاب الدولة إحداها من الجرائم ذات الطابع الدولي الأمر الذي دفع المجتمع الدولي للتعاون على مكافحة مثل هذه الجرائم والتي تمس النظام العام الدولي بأكمله.
لذا اقتضت منا الدراسة التأهيلية- قدر الإمكان- عند التعرض لمفهوم إرهاب الدولة إلقاء الضوء على بعض الموضوعات ذات الصلة في ثلاث فصول على النحو التالي:
الفصل الأول: المحاولات الفقهية والدولية في تعريف الإرهاب.
الفصل الثاني: إرهاب الدولة وأركان الجريمة الدولية.
الفصل الثالث: مظاهر الجهود الوطنية والدولية في مجال مكافحة جرائم الإرهاب الدولي.
