يعتبر البحث عن مسألة ولاية الفقيه الشيعي من الموضوعات الفقهيه الشائكة والمعقدة التي تتطلب اطلاعا عميقا علي المباني الفقهية عند الشيعة الإثني عشرية . لكن من الواضح أن نظرية ولاية الفقيه تجربة فقهيه وتجريبية تستحق الدراسة والتأمل ، وهذا لا يعني أننا بصدد تجربة مثالية متكاملة لنظام الحكم في الأسلام ، لان هذه النظرية بلا أدني شك لها كثير من السبلبيات ، ولكن مع التسليم بهذا الا أنه لا ينفي قطعا أهمية ان تدرس ونتعلم من ايجابيانها ونحاول تقييم سلبياتها، لوضع الحلول المناسبة لها، وهذا علي عكس ما يتصوره البعض من وجوب الإعراض عن دراسة هذه النظرية ومثيلاتها من موارد الفكر الشيعي .
