صدر القانون رقم 1 لسنة 2000 بإصدار قانون تنظيم بعض أوضاع وإجراءات التقاضي في مسائل الأحوال الشخصية، وألغي قوانين الإجراءات السابقة عليه في هذه المسائل، ليعمل علي توحيدها، وعموما، لتشمل جميع المصريين مسلمين وغير مسلمين، ولتشمل أيضاً ما يثور أمام قضائنا من أقضيات خاصة بالأجانب.
وعلي الرغم من طول الزمن علي إعداد هذا القانون- الذي اقتصر علي بعض المسائل- فقد ثار جدل طويل- ومازال- حول بعض المسائل التي نظمها، ولا نري داعياً لتناولها علي إنفراد.
وقد أثرنا أن نتناول هذا القانون بالتعليق علي نصوصه، وأن نبسط رأي الفقه فيها- لما لمسائل الأحوال الشخصية من طبيعة خاصة- وأحطنا بعض هذه النصوص ببعض المواد الفقهية التي تساعد علي توضيحها، لأن الأحكام التي تتعلق بنظام الأسرة وتكوين البيت كالزواج والطلاق والرجعة والميراث وغير ذلك من الأحكام، هي أحكام موضوعية لها طبيعة تنفرد بها عن أحكام إجراءات التقاضي.
