وهذا الكتاب يتناول تحديداً علمُ الفقه... وحين النظر في هذا العلم من حيثُ إثارةُ مجالاتٍ النظر والتفكير فيه فلا بُدَّ من إستحضار أمر، وهوان علم الفقه علمٌ إصلاحيٍّ، يعالج ما يعرض للناس بمختلف أجناسهم، وأعراقهم، وأزمانهم، وأماكنهم، أفراداً كانوا أو جماعات، حكاماً أو محكومين... ولا غروّ أن كان كذلك إذ موضوعُه - والعلوم إنما تتمايز بموضوعاتها - أفعالُ المكلفين.
وإذا كان هذا هو موضوعَه، وكانتْ أفعال المكلفين متجددةً مسايرةً لزمانها وما تمليه عليه ظروفها = فلا بُدَّ من تجديدٍ النظر في علم الفقه، المرَّة بعد الأخرى، من أفراد الأمة وجماعاتها، وذلك لتكون مشاريعُ الأمة الإصلاحيةُ مبنيةً على أساسٍ من الفقه مكينٍ، مواكبةً لمستجدات العصر وما تتمخَّض عنه الظروف الراهنة.
