لا شكّ أن المرأة هي الأمُّ الحَنُون والإبنة الرقيقة والأخت الرؤوم والخالة والعمّة، والزوجة التي هي السكن والمودة والرحمة، وهي المُعين في إدارة حياة الرجل.
ومن النّادر أن نجد قضية اختلفت فيها وجهات النظر بمثل ما اختلفت وتعدّدت في قضيّة المرأة، هذه القضية التي تعدّدت فيها التشريعات ووجهات نظر المفكرين والفلاسفة ودُعَاة الإصلاح على مر العصور، حتى وصل التعدد إلى مستوى التناقض والإختلاف الجذري الذي لا إمكان معه للقاء أو إتفاق أو تقارب.
ولا عَجَبَ في هذا التَّعدُّد والإختلاف وكثرة الخائضين، فقضيّة المرأة إنّما تعنى وتخصّ نصف البشرية، والعمران الإنساني في ماضيه وحاضره ومستقبله، بل تعنى عند التحقيق أكثر من ذلك؛ لأن أوضاع المرأة تُؤثّر بالسلب والإيجاب على كافة أوضاع العُمران البشري في عمومه؛ والمرأة إنما هي الأم، والبنت، والأخت، والزوجة، وهي تُؤثَر في هؤلاء جميعهم وتتأثر بهم.
إذن قضية المرأة إنّما هي قضية المجتمع البشري كله، وليس العجب في هذا، إنّما العجب في الضجيج والثرثرة الكلامية حول مكانة المرأة التي تولَى كِبْرهَا طائفة من الغوغاء نسبتْ إلى الشريعة الإسلامية الغَرّاء ظلم المرأة، ونسجت وهما لا أصل له عند الحديث عن قضايا المرأة، في ميراث المرأة وعلاقته بميراث الرجل، وجعل هؤلاء الجهال من قوله تعالى: ﴿لِلذَّكَرِ مِثْلُ حَظِّ الْأُنثَيَيْنِ﴾... [سورة النساء: آية 11] ساحة تفكهِ وتندر، وإزاء ذلك رفع المتباكون على المرأة شعار المساواة في الميراث والمناداة بتعديل أو إلغاء قانون الأحوال الشخصية في العالم العربي، المستمد من الشريعة الإسلامية.
وفي هذا تناول الدكتور كمال النجار القضايا التي تتعلق بالمرأة قديماً وعند مختلف الديانات والحضارات للرد على الشبهات حول مكانة المرأة في الإسلام.
