إن سلطة إقامة القضاء في كل دول هي أحد مظاهر السيادة فيها ولذلك فسماحها دون قيد بامتداد اثار الأحكام الأجنبية على اقليمها يمثل في الحقيقة مداً للسلطة القضائية الأجنبية على الاقليم الوطني بما يخل بسيادة واستقلال الدولة.
ورغم أن المشرع المصري قد عالج هذا الموضوع في قانون المرافعات الحالي رقم 13 لسنة 1968 في المواد من 296 حتى 301 إلا أن هذا العلاج جاء منقوصاً إلي حداً ما، وسأحاول قدر جهدي معالجة الموضوع علاجاً شاملاً بغية التعرف على أبعاده المختلفة سواء كان ذلك عن طريق الدراسة المقارنة للموضوع في النظم القانونية المختلفة، أو عن طريق دراسة نظام تنفيذ الأحكام الأجنبية في مصر منذ تشريعات المرافعات المختلطة والأهلية وحتى قانون المرافعات الملغى، ثم نعالج الوضع في التشريع الحالي، مع الإشارة إلى اجتهادات الفقه، وما جرى عليه العمل في القضاء، وذلك إيمان منا بأن الفقه والقضاء والتشريع يكونون مثلنا متكامل الأضلاع لا غنى لأحديهما عن الأخرين ثم نبحث الوضع في المعاهدات الدولية المتعلقة بالموضوع والتي انضمت إليها مصر بوصفها طرفاً فيها سواء كانت معاهدات ثنائية أو معاهدات جماعية، وقبل كا هذا لابد أن نعرض لمفهوم الحكم الأجنبي في القانون الدولي الخاص.
