بسبب تضارب المصالح الخاصة، لا بد أن يكون البشر ميالين إلى التنازع والإختلاف.
ولا بد من وجود سلطة، وقانون، وعدالة تضبط البشر.
والقانون يشمل النصوص التي تصنعها الدولة، والأعراف والعادات التي تجذّرت في النفوس وأصبح لها سلطانها في توجيه الأفكار والسلوك.
وإن مجتمع العشائر ليس مجتمعاً متخلفاً، بل للعشائر ثقافتها العريقة الأصيلة .. يفصح عن تلك الثقافة ما يُعرف (بالعُرف) الذي يمثل عنصراً من عناصر القانون نظرياً وعملياً.
وللقبائل والعشائر تاريخ حافل بالعادات والتقاليد الحميدة. وكريم تلك العادات، ونبيل تلك التقاليد والأعراف مقرّة كقانون غير مدوّن ترجع القبائل والعشائر في حل خلاقاتها ومشاكلها.
وتكون الحلول ملزمة للأطراف المتنازعة رغم صرامتها أحياناً، لكنها مقبولة طوعاً وتسمى تلك الأعراف (بالسواني).
أي سنن العشائر كونها المصدر العُرفي للمسؤولية في العشيرة، التي تكونت من مجموعة من القواعد المتوارثة وأصبحت لها مع مرور الأيام مكانة القانون الوضعي المدوّن تحت حياتهم وتضبطها، ويقبلون بها لأنها تكفل لهم العدالة والإنصاف حسب أعراف العشيرة ..
وما زالت العشائر ترى أن كل نزاع لم يُحسَم وطبقاً للأعراف العشائرية تبقى آثاره مهما نال المعتدي من جزاء طبقاً للقانون المدون المطبّق في المحاكم العامة.؟!
وما دامت الحال هكذا .. تُلجِئنا الأمور إلى (فريضه) وهو قاضٍ عشائري غير رسمي ترتضيه الأطراف العشائرية المتناوعة ليحكم بينها، ويكون حكمه مطاعاً من أطراف النزاع، وملزم التنفيذ.
هذا الكتاب ... يبحث في مسائل الحقوق والأحكام العشائرية، ويستشهد ببعض الوثائق المسماة بـ "السنينة" وبعض الحوادث .. كما عمل على المقارنة بين هذا القضاء والشريعة الإسلامية.
والفصل العشائري ما زال معتمداً لا بل تكرس في الآونة الأخيرة بحيث أصبح الشريعة المعتمدة بين أبناء العشائر.
هو بحث يتميز بالدقة وسعة الإستقصاء.
