تعتبر حماية المشتري في عقد بيع عقار تحت الإنشاء وسيلة مهمة في إقبال المواطن على هذا العقد، كونه أصبح من أهم العقود وأكثرها شيوعاً في الوقت الحاضر، بسبب زيادة حاجة كثير من الدُّول للمشاريع العقارية التي توفر السكن للمواطن محدود الدخل الذي لا يستطيع إمتلاكها.
والواقع، أنَّ الإهتمام بحماية المشتري في هذه العقود يؤدي إلى مزيد من الإقبال عليها، هذا يعني أن المصلحة من التعاقد سوف تصب في مصلحة الطرفين (البائع - المشتري) على السواء؛ حيث يستفيد البائع من التمويل الممنوح له، أيَّ من الأقساط التي تُدفع من قِبَل المشتري، ما يساعده في إعمال عمليات البناء التي قد يَعجز في بعض الحالات على تمويلها بمفرده.
ولكن ما نلاحظه على أرض الواقع ومع غياب النصوص التشريعية التي تنظم هذا العقد سواء أكان في القانون العراقي أو اللبناني، مما يؤدي إلى ضياع حقوق المشتري (الطرف الضعيف في العقد)، فعملنا من ذلك إلى تسليط الضوء على بعض المواد القانونية محاولين من خلالها توفير أكبر قدر من الحماية لمشتري العقار تحت الإنشاء.
