كان من اللازم إصلاح المنظومة القانونية المتعلقة بحماية الملكية الصناعية بهدف جعلها تواكب المستجدات التي طرأت في الميدانين الصناعي والتجاري على المستوى الدولي، لذا تم إصدار القانون رقم 17-97 المتعلق بحماية الملكية الصناعية المنفذ بموجب الظهير الشريف رقم 1-00-97 المؤرخ في 15 فبراير 2000 ليستجيب للواقع السياسي والاقتصادي والاجتماعي السائد في المغرب والخيار الليبرالي الذي تبنته الدولة، والانفتاح على الخارج واستقطاب الرأسمال الأجنبي؛ الأمر الذي استدعى وضع تشريع فعال يضمن حماية حقوق الملكية الصناعية ويوفر ظروفا مناسبة للمستثمرين المغاربة والأجانب في أفق تدويل المبادلات التجارية العالمية لا سيما بعد التوقيع على الاتفاق النهائي لمفاوضات الكات سنة 1994 والذي أسفر عن ميلاد المنظمة العالمية للتجارة، فضلا عن دخول الاتفاق حول حقوق الملكية الفكرية المتصلة بالتجارة حيز التطبيق وتقسم مقتضيات القانون رقم 17-97 المتعلق بحماية الملكية الصناعية إلى تسعة أبواب تتعلق على التوالي بأحكام عامة، وببراءات الاختراع وبتصاميم تشكل الدوائر المندمجة، وبالرسوم والنماذج الصناعية وبعلامات الصنع أو التجارة أو الخدمة، وبالإسم التجاري وبيانات المصدر وتسميات المنشأ، وبالحماية المؤقتة في المعارض والمكافآت الصناعية وبالدعاوي القضائية، وبأحكام انتقالية.
