عرفت المجتماعات المختلفة الملكية الفردية من قديم الزمن. وقد انتشرت الملكية الشائعة في مصر بدخول الإسلام إليها، ومعرفتها لنظام الميراث، إلا أن القانون المدني السابق قد جاء مقتضبا أشد الاقتضاب في معالجته للملكية الشائعة، وذلك بسبب أنه قد حذا حذو القانون الفرنسي وسار علي نهجه.
وأمام هذا النقص التشريعي في القانون المدني السابق عمد القضاء المصري إلي إبتداع المبادئ والأحكام التي تنظم أغلب جوانب الملكية الشائعة لأهميتها وانتشارها في مصر نتيجة لنظام التوريث.
وقد أسفر العمل عن وجود عديد من المشكلات العملية التي طفت علي السطح في الآونة الأخيرة بالنسبة لكافة الصور المستحدثة من الملكيات الشائعة، سواء فيما يتعلق بإدارتها، أو التصرف فيها، أو قمستها رضاء، أو قضاء، وهو ما دعانا إلي إصدار هذا المؤلف.
وقد قمنا بتزويد هذا المؤلف فضلا عما تقدم بأحدث الأحكام التي أصدرتها محكمة النقض في العشرين ستة الأخيرة في مجال الشيوع ليشمل ما يحتاجه العمل القضائي الدقيق من دراسة عميقة للنصوص التي تنظم الملكية الشائعة وما هيتها، وكيفية إدارتها وطرق التصرف فيها وإجراءات قسمتها رضاء أو قضاء.
ومحتويات هذا المؤلف ندعو الخالق تبارك وتعالي أن يكون فيها السبيل الكافي للأداء الدقيق العميق، الذي هو المنهج الحق للقاضي والمتقاضي وصولا غلي الحق أيا كان جانبه.
