عالجت معظم التشريعات الحديثة التصادم البحرى فى قوانينها وفقاً للمعاهدات الدولية فى هذا الشأن بغرض تحديد المسؤلية والطرف المتسبب فى التصادم، وقد أخذ قانون دولة الإمارات العربية بالتصادم بسبب القوة القاهرة وتتحمل كل سفينة ما أصابها من ضرر.
لأجل ذلك وجدنا من الأهمية إيضاح المسؤولية المترتبة على التصادم البحرى وهل هى مسؤولية تقصيرية قائمة على فكرة الخطأ أم أنها مسؤولية عقدية، كما أن الإجراءات التى يتخذها الرُبان لها أهمية فى تحديد السفينة المتسببة فى الخطأ وذلك لصعوبة إبقاء السفن المتصادمة فى ذات الوضع الذى حدث فيه التصادم، كما أن الإختصاص فى تلك المسائل يشكل أهمية كبرى فى تحديد القانون الواجب التطبيق.
