"التمليك" كتاب يتضمن رسالة كتبها الشيخ محمد عظوم متحدثاً فيها عن قضية تتعلق بعادة أهل القروان في جعل عصمة الزوجة الثانية بيد الزوجة الأولى؛ إن شاءت أبقتها، وإن شاءت طلقتها على زوجها طلقة واحدة، أو اثنين أو ثلاثاً أو أعتقتها إن كانت كانت مملوكة. وهذا التزام يسجل في آخر عقد الصداق القيرواني وبمحضر شهوده. وقد تحدث الشيخ في هذه الرسالة عن اعتبار العادة، والعرف في الأحكام الفقهية، وعن معنى كل من التمليك، والتوكيل، والفرق بينهما، وعن دور النية في بيان ذلك، كما تحدث عن اقتران عقد النكاح بالشرط وما يترتب على ذلك من صحة هذا العقد أو فساده، وتحدث في آخر الرسالة عن التبرعات وأنواعها، وذكر أحكاماً كثيرة تتعلق بها. وقد اعتمد المصنف في تحرير هذه الرسالة على علماء المذهب المالكي. ونظراً لأهميتها من الناحية الفقهية، ولطرافة الآراء الواردة بها ووجاهتها، ونظراً لكونها عملاً علمياً تونيسيّاً جديراً بالتعريف، عمل الدكتور محمد الطاهر الرزقي على تحقيق هذه الرسالة، ليعرف بها وبمؤلفها.
