تختلف النظم القانونية في معالجة المسائل والأحكام المتعلقة بالمنافسة غير المشروعة والأسرار التجارية، وذلك بإختلاف النظر حول تصنيفها، وفيما إذا كانت تعد حقاً من حقوق الملكية الفكرية أو نسبتها إلى غير هذه الحقول.
بيد أنه لا يمكن إنكار نسبة الأسرار التجارية إلى حقول الملكية الفكرية واعتبارها أحد عناصرها، وهو ما استقرت عليه جميع الأنظمة القانونية التي استمدت ذلك من أحكام إتفاقيتي باريس وتريس وما أخذ به الفقه والتشريع الأمريكي من هذا الجانب.
وبالوقت ذاته فإنه لا يتصور الحديث عن المنافسة غير المشروعة ضمن طائفة حقوق الملكية الفدرية لعدم إعتبارها من قبيل تلك الحقوق ولا عنصراً فيها، وهي تمثل - بداهة - أداة الحماية القانونية بمواجهة الإعتداء على حقول الملكية الفكرية أو أي من حقوقها.
وقد نظم المشرع الأردني أحكام المنافسة غير المشروعة والأسرار التجارية ضمن قانون خاص هو قانون المنافسة غير المشروعة والأسرار التجارية الأردني، رقم (15) لسنة 2000 بإعتباره واحداً من المنظومة التشريعية الخاصة بحقوق الملكية الفكرية وذلك إستجابة وتنفيذاً لمتطلبات الإنضمام إلى المعاهدات والإتفاقيات الدولية وما قررته من شروط لذلك.
من هنا، يسعى هذا الكتاب إلى دراسة الأحكام القانونية للمنافسة غير المشروعة والأسرار التجارية، وبيان مفاهيم هامة كتعريف المنافسة غير المشروعة، وتعريف الأسرار التجارية، إضافة إلى تسليط الضوء على الأحكام العامة لكل منهما وفق أحكام القانون الأردني والتشريعات المصرية وما تضمنته إتفاقيتا باريس وتريس، بأسلوب المقارنة والمقاربة، ويشمل ذلك صور المنافسة غير المشروعة ومعايير إعتمادها وموقف التشريعات المقارنة منها، إضافة إلى تمييزها عن غيرها من الأنشطة والسلوكيات المخالفة لمبادئ القانون وضوابط الشرعية، وبالنهج ذاته تهدف الدراسة إلى بيان معايير وضوابط السرية وحالات إفشائها بما يعد تعدياً عليها وتحديد الحالات التي تمثل إفشاءً مباحاً قانوناً لما يعد سراً تجارياً.
