إن أحكام الشريعة الإسلامية منطوية على حِكم ومقاصد، غايتها الأساس سعادة الخلق في الدارين، بجلب المصالح لهم، ودرء المفاسد عنهم. ولما كانت أحكام الشريعة من وضع العليم الحكيم، فإن حِكَمَهَا ومقاصدها لا يمكن حدّها و لا عدّها، فهي تتكشف بتجدد الزمان وتنوع المكان، وتتجلى بحسب اختلاف مناهج التعليل والإستنباط عند من يروم معرفتها والوقوف عليها...
وإذا كان المجتهد هو المكلف ضرورة بمعرفة الأحكام الشرعية وكيفية تنزيلها على الوقائع والنوازل، فإن المعني أولاً وآخراً بمعرفة مقاصد الشريعة وإستحضارها في كل حكم يبحث عنه ويريد تنزيله على واقع الناس؛ إذ يلزمه في كل حكم شرعي أن يكون محققاً لمقصد شرعي يخدم الواقع الذي يعيشه، بعد أن يتم تطبيق ذلك الحكم في إجتهاد للوقوف على ما أراده الشارع وتغياه، وهذا كله لا يتأتى إلا بالتتبع الحسن لمقاصد الشريعة، والوعي التام بمستجدات الواقع.
ولا شكّ أن الفكر المقاصدي قطع مراحل كبيرة على المستوى النظري، حيث ظهرت فيه دراسات ونظريات كثيرة اهتمت ببسطه وتحليله وتقريبه، إلا أن التطبيق المقاصدي ما يزال يحتاج إلى مزيد من البحث والتحرير والتدقيق والضبط؛ فهو مجال خصب يتطلب من المهتمين بمقاصد الشريعة، الدارسين لها جهداً مضاعفاً؛ إذ هناك إشكالات وقضايا آنية، لا ينبغي للمجتهد والمفكر المقاصدي أن يغفل، أو يغض الطرف عنها، بل يلزمه البحث عن أجوبة مقنعة لها، في ضوء أحكام الشريعة ومقاصدها.
وقد تنبّه إلى كل ما سلف الأستاذ الدكتور إسماعيل الحسني، فانبرى للبحث في "مقاصد الشريعة وأسئلة الفكر المقاصدي"؛ ليلفت النظر إلى جملة من تلك الإشكالات والقضايا، من خلال طرح خبير لبعض الأسئلة المحورية في منظومة الفكر المقاصدي، مع محاولة الإجابة عنها بعين الباحث المفكر، الواعي بمبادئ علم مقاصد الشريعة، وضوابطه، وقواعده.
ومن الأسئلة المطروقة في هذا الكتاب القيم ما يتعلق بالمشتغل بهذا الفكر، والذي يفترض فيه التدقيق في البحث عن الأجوبة الحية لمختلف النوازل والقضايا التي تواجه واقعه، دون السقوط في وهدة التعميم والقياسات الخاطئة، ومنها ما يمس مقاصد الشريعة ودورها في ترسيخ الفكر العلمي في الفهم والإدراك، ومنها ما يتصل بالفكر المقاصدي، وإسهامه في ربط واقع الناس بأحكام الشريعة الإسلامية، ومنها ما يرتبط بمفهوم التمايز بإعتباره من أهم المفاهيم التي يرتكز عليها الفكر المقاصدي، وكذا لما له من دور في ترسيخ إنتماء المفكر المقاصدي إلى واقعه، ومنها قضية حرية التعبير عن الرأي والسبل الكفيلة يجعلها منسجمة مع مقاصد الشريعة، وظاهر أن إنتظام هذا الكتاب في كل هذه السؤالات النابضة، وفق هذا المنهج المبدع، قد جعل منه عِلقاً نفيساً قميناً بالمطالعة والمباحثة.
