يعالج هذا الكتاب الجوانب القانونية لقضية القدس إنطلاقاً من أحكام القانون الدولى التى تخضع للعلاقة بين القدس وإسرائيل لقانون الاحتلال الحربى ولذلك يحظر على إسرائيل المساس بالوضع الجغرافى والديموغرافى والحضارى للمدينة المقدسة. يستند هذا الحظر ابتداء إلى قرار التقسيم رقم 181، ثم إلى قرار مجلس الأمن 242 الذى يعتبر القدس كلها اراض محتلة تتمتع بحماية اتفاقية جينيف الرابعة التى تحظر نقل سكان الأراضى المحتلة أو الاستيلاء على اراضيهم ومنازلهم، كما تحظر نقل السكان اليهود ليحلوا محل السكان الفلسطينيين.. يستند وضع القدس أيضاً إلى اتفاق اوسلو الذى حظر المساس بالقدس حتى تكون محل مفاوضات الوضع النهائى. وقد شكل قرار مجلس الأمن 1980/428 ركناً هاماً فى حماية وضع القدس ومنع اتخاذها عاصمة لإسرائيل أو نقل البعثات الأجنبية إليها. ثم أكد فى محكمة العدل الدولية عام 2004 بدقة الوضع القانونى للقدس ورأيها الاستشارى حول الجدار العازل.
ولما كانت خطط التهويد تمضى بغير إكتراث بهذه الأحكام القانونية.. فقد اقترحت الدراسة خطة للتحرك القانونى لإحباط مسيرة المشروع الصهيونى فى القدس والذى تحركه دوافع استعمارية لا تعطى للقانون الدولى القيمة الواجبة.
