هذا كتاب فى مسألة خلع اليمين وإبطال الحيلة فيه, من تصنيف العالم الزاهد الفقيه أبى عبدالله: عبيد الله بن محمد بن بطه العكبرى الحنبلى, المتوفى سنة 387 هجري. وضعه فى الأصل جوابا على سؤال وجه إليه عن مدى صحة ما أفتى به بعض الفقهاء فى زمنه, رجلا حلف بالطلاق ثلاثا أنه لابد ان يقتل رجلا مسلما لأجل خصومة جرت بينهما, فأفتاه بالتحايل على هذه اليمين بأن يطالب زوجته بالانخلاع منه لتسقط عنه اليمين, ثم يعود إليها فيتزوجها من جديد, ويسقط عنه الوفاء بما حلف عليه.
وقد رأى المصنف أن لا يخلى هذا الجواب من فائدة, فوضع بين يديه مقدمة نفسية فى صفة الفقية الربانى, الذى ينبغى الفزع إليه عند المشكلات, واستفتائه عند نزول المعضلات, واستدل لذلك بأدلة الكتاب, والسنة, وأقوال السلف, بما قد لا تجده فى المطولات.
ثم عرج على موضوع الحيل بشكل عام, فبين مضرة الحيل فى دين الله, وما تؤدى إله من المروق من الدين, وساق الأدلة من الكتاب, والسنه, وأقوال أئمة الإسلام المعتد بهم, على تحريم الحيل وبطلانها فى الأحكام الشرعية.
ثم ختم الكتاب ببيان خطورة منصب الفتوى والجرأة عليها, ونقل عن السلف من الصحابة والتابعين فى هذا المقام مايشفي ويكفي.
