تكتسي هذه الدراسة التشريعي الفلسطيني المنتخب في كانون الثاني/يناير 1996 داخل الأراضي الفلسطينية المحتلة أهمية كبيرة، نظراً إلى طبيعة هذا المجلس المحدث بموجب الاتفاقيتين الموقعتين بواشنطن-الولى "إعلان المبادئ" الموقع في 13 أيلول/سبتمبر 1993، والثانية الاتفاقية الفلسطينية-الإسرائيلية للمرحلة الانتقالية للضفة الغربية وقطاع غزة الموقعة في 28 أيلول/سبتمبر 1995-اللتين حددتا تركيبة المجلس ومسؤولياته وحدود سلطاته التشريعية ضمن الولاية الجغرافية المحددة بالضفة الغربية وقطاع غزة.
وقد جرت انتخابات المجلس التشريعي المؤلف من ثمانية وثمانين عضواً بالتوازي مع انتخابات رئاسة السلطة الفلسطينية يوم 20 كانون الثاني/يناير 1996، بموجب قانون الانتخابات الفلسطيني المؤقت الصادر في 7 كانون الأول/ديسمبر 1995، محدثة بذلك أول مجلس تشريعي منتخب للشعب الفلسطيني يمارس سلطة التشريع في حدود الأطر المتفق عليها في الاتفاقية الفلسطينية-الإسرائيلية للمرحلة الانتقالية للضفة الغربية وقطاع غزة.
وعلى الرغم من أن هذا المجلس لا يمثل الشعب الفلسطيني في كل أماكن وجوده، واقتصار تمثيله على الجزء الموجود في الضفة الغربية وقطاع غزة-الأراضي الفلسطينية المحتلة عام 1967-فإنه عدّ نقطة تحول بارزة في النضال من أجل المشروع الوطني الفلسطيني، مقدماً تجربة انتخابية برلمانية جديدة في ظل مرحلة انتقالية مدتها خمس سنوات تتولى خلالها السلطة الفلسطينية إدارة الحكم الذاتي في الضفة الغربية وقطاع غزة بموجب اتفاق تنفيذ الحكم الذاتي في قطاع غزة ومنطقة أريحا الموقع بالقاهرة في 4 أيار/مايو 1994.
في إطار التعريف بهذا المجلس واختصاصاته تأتي الدراسة التي بيد أيدينا والتي تضمنت خمسة محاور يتناول المحور الأول الأسس القانونية والشرعية للمجلس التشريعي الفلسطيني، ويعرض المحور الثاني التركيبة السياسية والاجتماعية للمجلس، ويبحث المحور الثالث الدور التشريعي للمجالس، ويتناول المحور الرابع الأداء الرقابي للمجلس، وأخيراً يتعرض المحور الخامس إلى التطورات الدستورية في النظام السياسي الفلسطيني للمرحلة الانتقالية.
